About these terms
These Terms and Conditions govern your use of our website and any contract between you and us for the arrangement of a private distillery experience. By submitting an enquiry or confirming a booking, you acknowledge that you have read and accepted these terms. Please read them carefully before booking; they are intended to make clear what you can expect from us and what we expect from you.
Nothing in these terms affects the statutory rights you hold as a consumer under the Consumer Rights Act 2015, and any term that would otherwise exclude or restrict those rights shall apply only to the extent permitted by law.
Who we are
The website and the services described on it are operated by The Sunshine Tour, of Guildford Road, Rudgwick, Horsham, United Kingdom (VAT ID: GB 395324476; Registration Date: 2021-11-21). References to "we", "us", and "our" in these terms mean The Sunshine Tour.
Our services
We arrange private, tailored experiences at independently owned and operated distilleries in Scotland and Northern Ireland. Our role is that of an organiser and concierge: we coordinate distillery access, private tastings, transport, and hosting on your behalf, working with the distilleries and licensed transport operators who deliver the individual elements of your itinerary.
Because each experience is bespoke, the precise content of your itinerary — the distilleries visited, the expressions tasted, the modes of transport used — will be set out in the proposal we send you and in your booking confirmation. That confirmation, together with these terms, forms the contract between us.
Enquiries and bookings
An enquiry submitted through the website is an invitation to treat and does not create a contract. Following your enquiry, we will propose an itinerary and an itemised quotation. A contract is concluded only when we issue a written booking confirmation, after which these terms apply in full.
You are responsible for ensuring that the information you provide — including names, dates, party size, and any dietary or accessibility requirements — is accurate and complete. If your circumstances change after booking, please tell us as soon as possible so that we can assess what adjustments are feasible.
Prices and payment
All prices are quoted in pounds sterling and, unless stated otherwise, are inclusive of VAT at the prevailing rate. The price for your experience is the price set out in your booking confirmation; prices shown on the website as "from" indications are examples only and may vary according to season, party size, transport choices, and distillery availability.
Payment terms, including any deposit and the balance due date, are set out in your booking confirmation. Where a deposit is paid, it is applied towards the total price and is refundable in accordance with our cancellation provisions and our Refund Policy.
What is included
Unless your booking confirmation states otherwise, your experience includes the distillery visits and private tastings described, the services of your personal host, the transport arrangements specified, and any bottled personal bottling or similar item expressly listed in your itinerary. Travel to and from your home, accommodation (unless expressly included), travel insurance, and personal spending are not included.
Tastings are provided to guests aged 18 and over only. We reserve the right to refuse alcohol to any guest who appears intoxicated or who cannot provide evidence of age if we reasonably consider it necessary.
Your responsibilities
Distilleries are working industrial sites and transport environments such as helicopters and yachts carry their own safety regimes. You and your guests must follow all reasonable instructions given by your host, by distillery staff, and by transport crew, including safety briefings, and must not enter restricted areas unless expressly invited to do so.
You are responsible for disclosing, at the time of enquiry or booking, any condition, dietary requirement, or mobility consideration that may affect the arrangements we make. You must also ensure that your party consumes alcohol responsibly; we and the distilleries reserve the right to refuse service where consumption appears excessive.
Transport and third-party operators
Helicopter, yacht, and road transport elements are operated by independent, licensed third-party operators holding the certifications applicable to their mode of transport. While we select operators with care and coordinate the logistics, the operation of the aircraft, vessel, or vehicle itself is under the control of the operator, whose safety instructions and carriage conditions apply during the journey.
Weather and operational constraints may require a change of routing or mode at short notice. Where a transport element cannot proceed as planned, we will arrange a reasonable alternative or adjust your itinerary accordingly.
Changes to your itinerary
Distillery access is subject to production schedules, and a distillery may occasionally need to alter or withdraw access at short notice for operational or safety reasons. Where this happens, we will substitute a comparable visit or element wherever possible. Minor changes that do not materially affect the overall character of your experience do not give rise to a refund, though we will always seek to preserve the substance of what you booked.
Cancellation
You may cancel your booking at any time by giving us notice in writing. Cancellation charges are calculated by reference to the date of departure: a full refund is available for cancellations made 30 or more days before departure; a 50% refund for cancellations made between 29 and 14 days before departure; and within 14 days of departure we offer a one-time date transfer valid for 12 months in place of a refund. If we cancel your experience for a reason within our control, you will receive a full refund of amounts paid, or a date transfer if you prefer. Our Refund Policy explains the process and the timeframes that apply.
Our liability
Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud, or for any other liability that cannot be excluded or limited under the laws of England and Wales. Subject to that, our total liability to you in connection with your booking shall not exceed the total price paid for the experience to which the claim relates.
We are not liable for loss or damage caused by events outside our reasonable control, for the acts or omissions of independent transport operators to the extent those acts fall within the operation of their vehicles, vessels, or aircraft, or for indirect or consequential losses that were not a foreseeable result of a breach on our part at the time your booking was confirmed.
Force majeure
Neither party is liable for delay or failure to perform caused by events outside its reasonable control, including severe weather, industrial action, war, terrorism, public health measures, or the unexpected closure of a distillery or transport route. Where such an event prevents your experience from taking place, we will offer a date transfer or a refund in accordance with our Refund Policy, having regard to any costs already incurred with third parties.
Complaints
If something goes wrong during your experience, please tell your host at the earliest opportunity so that we have a chance to put it right on the day. Any further complaint may be sent in writing to our registered address, and we will acknowledge it promptly and respond within 14 days. Our aim is to resolve any issue fairly and quickly.
Governing law
These terms and any dispute arising out of or in connection with them are governed by the laws of England and Wales, and the courts of England and Wales shall have jurisdiction, without prejudice to any mandatory consumer protections available to you in your country of residence.
